This process is commonly referred to as making a small claim and is typically used to recover money owed or resolve disputes over faulty goods, poor service, or breach of contract.

Before starting court action, it’s important to understand that going to court can be stressful, time-consuming, and sometimes costly. However, as paralegals, our fees are far lower than a solicitor’s.

For this reason, making a small claim is usually only worthwhile if the item or service involved was particularly expensive or if the financial loss is significant enough to justify the effort.

If you attempted to resolve the dispute using alternative dispute resolution (ADR)—such as mediation, arbitration, or an independent complaints scheme—the court will take this into account. Judges often look favourably on claimants who have tried to settle the issue outside of court first, and the court may consider the ADR scheme’s decision when reviewing your case.

In many situations, demonstrating that you made reasonable efforts to resolve the dispute before starting legal action can strengthen your claim and improve your chances of a successful outcome.
